The Executive has decided to maintain the regulations in force on international adoptions

Today, the Executive has approved the amendment of law on the legal regime of adoptions, in order to support the families that want to make adoptions, for a quicker reintegration of adoptable children in the new family.
“The Executive has decided, on the express request of Prime Minister, that the current regulations on international adoptions are maintained. In other words, the amendments made today aim only at internal adoptions’ requests”, Mrs. Ioana Muntean, Spokesperson for the Executive has stated.
The legal framework in terms of adoption has been reviewed in the sense of redefining the notions of internal and international adoption and introducing the criterion of adopting family residence instead of the domicile criterion.
Also, a series of provisions aiming at the substance conditions of adoption have been correlated with the new Civil Code, Mr. Bogdan Panait, Secretary of State, the Romanian Office for Adoptions (ORA) has explained.
Furthermore, the new regulations offer solutions for certain categories of children, such as those with unknown parents, to be quicker adopted. Thus, children with unknown parents can be declared adoptable 30 days following the issuance of their birth certificate.
There has been regulated the situation of children in the social protection system, for whom the parents show no interest for one year, so that they can be declared adoptable after one year, in case the social assistance directorate clearly notice that there was no bond between child and their biological family, and there are no chances of reintegration into this family.
Other important regulation approved by the Executive refers to the introduction of ADN test for approving the adoption of children from extramarital affairs of spouses.
The legislative act introduces at the same time a two - year monitoring period in which family counseling is provided for securing a successful reintegration of the adopted child.
The draft law was sent to Parliament for approval under emergency procedure.
